1. PURPOSE AND SCOPE

This document clarifies the relationship between applications published by the Publisher and any third-party trademarks, brand names, programs, or methodologies referenced within those applications, marketing materials, or supporting documentation.

The Publisher’s applications are distributed via the Apple App Store and the Google Play Store and are therefore made available in every country and territory those platforms serve. This Disclaimer applies globally. The Publisher applies EU trademark law (Regulation (EU) 2017/1001 on the EU trade mark and Directive (EU) 2015/2436) and the nominative-fair-use doctrine as its baseline standard and additionally observes the trademark and fair-use rules of every jurisdiction in which the applications are made available.

2. NOMINATIVE FAIR USE

References to third-party trademarks, brand names, programs, or methodologies within the Publisher’s applications and materials are made under the doctrine of nominative fair use — in EU law Art. 14(1) of Regulation (EU) 2017/1001 and, in Germany, § 23(1) nos. 2 and 3 MarkenG — or comparable doctrines under other applicable trademark law.

Such references are intended to:

Identify the third-party program, methodology, or product accurately
Provide context for the user about compatibility, support, or applicability
Enable factual descriptions of features and functions

References do not imply:

Endorsement of the Publisher’s app by the trademark owner
Affiliation between the Publisher and the trademark owner
Sponsorship of the Publisher’s app by the trademark owner
Authorization, certification, or approval by the trademark owner

3. TRADEMARK OWNERSHIP

All trademarks, registered trademarks, service marks, brand names, and trade names referenced in the Publisher’s applications or materials are the property of their respective owners.

The Publisher claims no ownership of such third-party intellectual property and uses them only for the purposes described in Section 2.

3.1 Marks referenced in `MacBusinessSuite`

MacBusinessSuite refers to the following third-party names and marks, in each case only to identify the product, standard or service concerned: Apple, Mac, macOS, Mac App Store, App Store, TestFlight and Apple ID (Apple Inc.); OpenAI (OpenAI OpCo, LLC and affiliates); XRechnung (KoSIT — Koordinierungsstelle für IT-Standards); ZUGFeRD (FeRD — Forum elektronische Rechnung Deutschland); Factur-X (FNFE-MPE); Peppol (OpenPeppol AISBL); DATEV (DATEV eG); DATANORM (the DATANORM standard of the German building-services trade); PayPal (PayPal, Inc.); Stripe (Stripe, Inc.); Microsoft Excel (Microsoft Corporation); SEPA (European Payments Council); VIES (European Commission). None of these owners is affiliated with, sponsors or endorses MacBusinessSuite, and compatibility with a format or service does not imply certification by its owner unless the app says so expressly and names the certifying body.

4. INDEPENDENT DEVELOPMENT

Applications published by the Publisher are independently developed.

The Publisher’s applications are not affiliated with, endorsed by, sponsored by, or approved by any third-party trademark owner unless explicitly stated in writing
Functional similarity between an application and a third-party program does not imply licensing or partnership
Compatibility with a third-party methodology does not imply certification or accreditation

5. RIGHTS RESERVED

Trademark owners retain all rights to their trademarks. The Publisher’s nominative fair use does not transfer, license, or grant any rights to the third-party trademarks.

6. TRADEMARK COMPLAINTS

If you are a trademark owner and believe that a Publisher application or material uses your trademark in a manner that exceeds nominative fair use or otherwise infringes your rights, please contact:
